Welcome to Forex Market Hours (the “App”), operated by FX Core. By downloading, installing, or using the App, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms apply to users worldwide, and specific provisions may apply based on your jurisdiction.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have the legal capacity to enter into these Terms. If you are under the legal age of majority in your jurisdiction (often 18 years old), you represent that you have obtained verifiable parental or guardian consent to use the App and agree to these Terms. If you are a parent or guardian agreeing to these Terms on behalf of a minor, you are responsible for their use of the App.

2. Scope of License

  • License Grant: We grant you a non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on compatible devices that you own or control, solely for personal, non-commercial purposes, subject to these Terms and the terms of service of the platform from which you downloaded the App (e.g., Apple App Store, Google Play Store, or other app stores, collectively referred to as “App Stores”).
  • Restrictions: You may not:
    • Copy, modify, or create derivative works of the App, except as expressly permitted by us or applicable law.
    • Transfer, sublicense, lease, lend, or rent the App to any third party.
    • Reverse-engineer, disassemble, or decompile the App, except to the extent permitted by applicable law.
    • Remove, alter, or obscure any proprietary notices (e.g., copyright or trademark notices) within the App.
  • App Store Rules: Your use of the App must comply with the usage rules and policies set forth in the terms of service of the respective App Store from which you downloaded the App, which are incorporated herein by reference.

3. Use of the App

  • Prohibited Activities: You agree not to:
    • Use the App for any illegal or unauthorized purpose.
    • Interfere with or disrupt the operation of the App or servers, including through denial-of-service attacks or similar activities.
    • Use the App to transmit harmful content, including viruses, malware, or other destructive code.
    • Attempt to gain unauthorized access to any portion of the App, other user accounts, or connected systems.
  • Account Responsibility: If the App requires an account, you are responsible for maintaining the confidentiality of your account information and for all activities under your account. For minors, parents or guardians may be required to assist in setting up or managing accounts.

4. In-App Purchases and Subscriptions

  • In-App Purchases: Forex Market Hours offers certain features, content, or services that can be purchased within the App (“In-App Purchases”). All In-App Purchases are final and non-refundable, except as required by applicable law or as specified by the platform provider (e.g., Apple App Store, Google Play Store, or other App Stores).
  • Subscriptions: Forex Market Hours may offer subscription plans for access to premium features or content. By subscribing, you agree to recurring payments at the specified intervals until you cancel your subscription. Payments will be charged to the payment method associated with your App Store account.
  • Trial Offers: Some subscriptions may include a free trial period. If you do not cancel before the trial period ends, you will be automatically charged for the subscription at the rate disclosed at the time of sign-up. Instructions for cancellation are available in the App or through your respective App Store account settings.
  • Cancellation and Refunds: You may cancel subscriptions at any time through your respective App Store account. Refunds for subscriptions or In-App Purchases are subject to the policies of the App Store from which you downloaded the App and applicable law. We do not directly process refunds.
  • Minors and Purchases: If you are under the age of majority in your jurisdiction, you must obtain parental or guardian consent before making any In-App Purchases or subscribing to services.
  • Payment Processing: All payments for In-App Purchases and subscriptions are processed through the respective App Store from which you downloaded the App. You acknowledge that we do not control payment processing or store your payment information directly.

5. Intellectual Property

All content, trademarks, logos, software, and other materials in the App are owned by or licensed to FX Core and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, distribute, or create derivative works from any content in the App without our prior written consent. You acknowledge that no title to the intellectual property in the App is transferred to you, and all rights not expressly granted are reserved by us.

6. User Content

If the App allows you to submit content (e.g., reviews, comments, or uploads), you retain ownership of such content but grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license (with the right to sublicense) to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in any media for the purpose of operating, promoting, and improving the App. You represent and warrant that you have the necessary rights to grant this license and that your content does not violate any laws or infringe on the rights of others.

7. Privacy Policy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

  • For EU Residents: We comply with the General Data Protection Regulation (GDPR). If you are located in the European Economic Area (EEA), you have specific rights regarding your personal data, including the right to access, rectify, or delete your data. Please refer to our Privacy Policy for more details.
  • For US Residents: We adhere to applicable US federal and state laws regarding data privacy, including the Children’s Online Privacy Protection Act (COPPA) for users under 13 years of age. Depending on your state of residence (e.g., California under the California Consumer Privacy Act – CCPA), you may have additional rights over your personal information.   • Minors’ Privacy: We take special care to protect the privacy of users under the age of majority. For users under 13 in the US (or equivalent age thresholds in other jurisdictions), we require verifiable parental consent before collecting personal information, in compliance with COPPA and similar laws.

8. Updates and Maintenance

We may, from time to time, release updates to the App to improve functionality, fix bugs, or comply with legal requirements. You acknowledge that we are not obligated to provide updates or support for the App. Some updates may require you to install the latest version to continue using the App. We may also temporarily suspend access to the App for maintenance or other reasons without prior notice.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the App will cease, and you must delete all copies of the App from your devices. Any active subscriptions may also be terminated in accordance with the policies of the respective App Store. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property rights, limitation of liability) will remain in effect.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, secure, or compatible with your device. You use the App at your own risk.

  • EU Users: If you are an EU consumer, you may have additional rights under EU consumer protection laws that cannot be disclaimed.

11. Limitation of Liability

To the maximum extent permitted by law, FX Coreand its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms or the App shall not exceed the amount you paid, if any, to use the App.

  • EU Users: If you are an EU consumer, this limitation may not apply to claims related to non-conformity of the App with these Terms, and you may have additional rights under EU consumer protection laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless [Your Company Name], its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction, e.g., State of California, USA], without regard to its conflict of law principles, except where local laws provide otherwise for mandatory consumer protections.

  • For EU Users: If you are a consumer in the EU, you may bring a claim to enforce your consumer protection rights in the courts of your country of residence. Additionally, you may use the European Commission’s Online Dispute Resolution platform (available at ec.europa.eu/consumers/odr) for resolving disputes.
  • For US Users: Any disputes arising under these Terms shall be resolved in the state or federal courts located in [Your City/Region, e.g., San Francisco, California], unless otherwise required by applicable state law.
  • Global Users: For users outside the EU and US, disputes will be resolved in accordance with the governing law specified above, unless local laws mandate otherwise.

14. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

15. Third-Party Terms

  • App Store Providers as Third-Party Beneficiaries: You acknowledge and agree that the providers of the App Stores (e.g., Apple, Google, and their subsidiaries) are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, such providers will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries thereof.
  • Compliance with Third-Party Terms: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • No Responsibility for App Store Providers: You acknowledge that the App Store providers (e.g., Apple, Google) have no obligation to furnish maintenance or support services for the App, handle warranty claims, or address product liability claims related to the App.
